Les conditions générales de vente (CGV) présentées ci-dessous régissent les ventes réalisées par notre société NACREMENT BELLE et concernent exclusivement cette société et toute personne physique ou morale (le Client) effectuant un achat sur ce site.
The GCS may be modified at any time, the user of the website and the Customer acknowledge having read the GCS then in force on the date of placing an order. By placing an order, the Customer expressly accepts all the terms of the GCS in force on the date of his purchase.
ARTICLE I. PRODUCT ORDERS
The Customer can place his order on our website, the contractual information is presented in French. Orders on the NACREMENT BELLE website are made through a secure connection.
NACREMENT BELLE se réserve, d’une part, le droit pour les commandes venant d’un pays étranger avec un règlement présentant un caractère suspect (carte bancaire suspecte, risque bancaire, risque douanier…) de ne pas procéder à la livraison de la commande sans avoir procédé à des vérifications supplémentaires qui pourraient retarder les délais de livraison et d'autre part, le droit d'annuler ou de refuser toute commande d'un client avec lequel il existerait un litige relatif au paiement d'une commande antérieure.
Any order from the customer, which has been confirmed by sending an order confirmation, is considered firm and definitive, as of its receipt by the company NACREMENT BELLE.
Any modification of an order, for any reason whatsoever, requires the prior written consent of NACREMENT BELLE. Delivery of an order will only be made upon full receipt of payment for the order by the customer.
SECTION II. PRICE IN EFFECT, CONDITIONS AND PRICING PRACTICES
All the prices indicated are public prices and are in euros, all taxes included. In the event of an order to a country other than France, any customs fees or local taxes will be borne by the recipient. All orders, whatever their origin, are payable in euros.
NACREMENT BELLE reserves the right to modify its prices at any time, however any product purchased will be invoiced on the basis of the prices in force at the time of registration of the customer order. In all cases, the price to be paid by the customer is that indicated on the NACREMENT BELLE website at the time of purchase as well as in the order confirmation and the corresponding invoice.
The products remain the property of NACREMENT BELLE until full payment of the price by the customer.
SECTION III. PRODUCT AVAILABILITY
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. We strive to publish stock availability on our site in real time.
Indications on the availability of the products are provided to the customer in any event at the time of placing the customer's order. In the event of unavailability of a product after your order has been placed, NACREMENT BELLE will indicate without delay and by any means a new delivery time, upon receipt of the information received. In this case, the customer may cancel his order and be reimbursed for any deposit he has paid to the company NACREMENT BELLE.
Reimbursement will be made at NACREMENT BELLE's discretion by crediting the customer's bank account.
In the event of default, NACREMENT BELLE reserves the right to cancel all or part of the orders already paid for and undertakes in this case to reimburse the customer for any sums he has already paid.
SECTION IV. DELIVERY OF PRODUCTS
All orders will be processed upon receipt of full payment from the customer. The time taken to validate payment and ship the order varies depending on the method of payment chosen. In any case NACREMENT BELLE reserves the right not to proceed with the delivery of an order if there is any doubt about the integrity of the payment by the customer.
The delivery of the ordered products is made to the delivery address indicated by the customer during the ordering process. NACREMENT BELLE cannot be held responsible in the event of an error in the indication of the delivery address by the Customer. The customer also has the possibility of taking possession of his jewel directly at the premises of NACREMENT BELLE, in Saint Denis, Reunion Island. To do this, he will send an email to contact@nacrementbelle.com to arrange an appointment.
The average shipping time is 48 to 72 hours from the date of receipt of full payment by the customer. These times correspond to the usual processing and delivery times for France. For any order from abroad, the delivery time may vary according to different parameters (means of payment, country of delivery, customs fees, etc.).
The customer can ask for the cancellation of his order if and only if the expedition of this one did not take place, at the latest, seven (7
) working days after the date of dispatch indicated by NACREMENT BELLE, unless this delay in dispatch is due to a case of force majeure within the meaning of the case law of the French courts, to an error in the delivery address indicated by the customer, non-receipt of payment from the customer or failure to perform/delivery by the carrier in charge of the delivery.
ARTICLE V. SECURE PAYMENT
The NACREMENT BELLE website uses a secure payment platform with the 3DSecure system which guarantees optimum reliability and protection of the customer's bank details.
Payment for customer purchases is made in cash by credit card (VISA, MASTERCARD).
SECTION VI. REFUND FOLLOWING RETRACTION & RETURNS
In accordance with the law in force, the customer has a withdrawal period of 14 days concerning our new products from the receipt of the order placed on the NACREMENT BELLE website. However, the costs of returning the product are the responsibility of the customer, who must ensure that the product is delivered by secure express delivery.
Reimbursement may be made by the same means of payment as for the purchase or another means of payment at no additional cost to the customer. Note that in the event of payment by credit card, NACREMENT BELLE will reimburse the customer by deducting the collection costs linked to the initial payment made by the customer.
SECTION VII. INTELLECTUAL PROPERTY
All of the texts, comments, works, illustrations and images reproduced on the NACREMENT BELLE website are reserved under copyright and intellectual property.
SECTION IX. APPLICABLE LAW - DISPUTES
This contract is subject to French law. The language of this contract is French.
In the event of a dispute, the French courts within the jurisdiction of the registered office of the company NACREMENT BELLE will have sole jurisdiction.
